These Terms of Service (“Terms”) govern your use of the Companion Elite LTD website and any concierge-related services provided by Companion Elite LTD (“Companion Elite”, “we”, “us”, or “our”). By using our website, submitting an enquiry, or engaging our services, you agree to these Terms.
1. About Our Services
Companion Elite provides private concierge and lifestyle support services in the United Kingdom. Services may include:
- Restaurant reservations
- Event and ticket requests
- Private club-related arrangements
- Chauffeur and transfer coordination
- Travel planning
- Personal requests and bespoke arrangements
All services are subject to availability, feasibility, supplier acceptance, and individual confirmation.
2. Nature of the Relationship
Unless otherwise agreed in writing, Companion Elite acts as a concierge facilitator and coordinator. In many cases, services requested by clients are ultimately delivered by independent third-party suppliers, venues, transport providers, event organisers, hospitality businesses, or other partners.
We do not guarantee that every request can be fulfilled, even where a request has been received, reviewed, or discussed.
3. Enquiries and Acceptance
Submitting an enquiry through our website, by email, WhatsApp, or otherwise does not create a binding agreement.
A service engagement is only formed when we confirm that we are able to proceed with the request and any applicable fees, deposits, payment terms, and service scope have been agreed.
We reserve the right to decline any enquiry or request at our discretion.
4. Client Responsibilities
You agree to:
- Provide accurate, complete, and timely information
- Respond promptly where information or confirmation is required
- Ensure that all information provided by you is lawful and does not infringe the rights of others
- Comply with the terms, rules, and policies of any third-party provider involved in your request
- Behave respectfully and lawfully in all dealings connected with our services
You are responsible for reviewing the details of any arrangements communicated to you and notifying us promptly of any error.
5. Pricing and Payment
Our website may display indicative or starting prices only. Final pricing is determined individually based on:
- Type of request, urgency, and complexity
- Supplier costs and access requirements
- Timing, location, and scope of coordination involved
Unless otherwise agreed:
- All fees must be paid in the currency specified by us
- Payment deadlines must be observed strictly
- Third-party costs may require advance payment or deposit
- Confirmed bookings, reservations, or arrangements may be non-refundable depending on supplier terms
We may require full or partial payment before beginning or completing work.
6. Third-Party Suppliers
Where services involve third parties, their own terms, conditions, cancellation policies, eligibility criteria, entry rules, and operational requirements may apply.
Companion Elite is not responsible for:
- Acts, omissions, delays, cancellations, refusals, overbooking, closures, or failures by third-party suppliers
- Changes made by venues, clubs, restaurants, transport providers, event organisers, or travel suppliers
- The quality, safety, legality, or suitability of third-party goods or services
- Denied entry, refused booking, or changed access conditions imposed by third parties
Any booking, reservation, access, or arrangement remains subject to the final decision of the relevant third party.
7. No Guarantee of Outcome
While we use reasonable efforts and professional care in handling requests, we do not guarantee:
- Availability of any venue, table, ticket, club, or service
- Access to any location or experience
- Uninterrupted website availability
- That any request can be completed within a specific timeframe unless expressly confirmed in writing
8. Changes, Cancellations, and Refunds
Because our services are often bespoke and time-sensitive, cancellation and refund rights may be limited.
Where a request has already required time, coordination, supplier contact, sourcing, or commitment of resources, fees may remain payable even if the arrangement is later cancelled by you.
Refunds, if any, are assessed on a case-by-case basis and may depend on the stage of the request, non-recoverable third-party costs, supplier cancellation terms, and work already performed by us.
If a third party cancels or changes an arrangement, we will use reasonable efforts to assist, but we are not liable for losses arising from such cancellation or change.
9. Confidentiality
We understand the importance of privacy and discretion. Both parties agree to treat non-public information exchanged in connection with services as confidential, except where disclosure is required:
- To fulfil the request
- By law or regulation
- For professional advice
- To protect legal rights or legitimate interests
10. Prohibited Use
You may not use our website or services:
- For any unlawful, fraudulent, abusive, harmful, or misleading purpose
- To make requests on behalf of another person without authority
- To interfere with website operation or security
- To request services that would require us to act unlawfully or unethically
- To misuse, copy, or exploit website content without permission
We reserve the right to suspend or refuse service where misuse is suspected.
11. Intellectual Property
All content on the website, including text, branding, design elements, graphics, layout, and original materials, is owned by or licensed to Companion Elite unless otherwise stated.
You may not reproduce, distribute, modify, republish, or commercially exploit any website content without our prior written consent.
12. Limitation of Liability
To the fullest extent permitted by law, Companion Elite shall not be liable for:
- Indirect, incidental, special, or consequential loss
- Loss of profits, revenue, opportunity, goodwill, or anticipated savings
- Losses arising from third-party acts or omissions
- Losses caused by inaccurate information supplied by you
- Losses resulting from delays, disruptions, force majeure events, or circumstances outside our reasonable control
Our total liability in connection with any claim arising out of or relating to our services shall not exceed the amount actually paid by you to us for the specific service giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
13. Force Majeure
We shall not be responsible for any delay, failure, or disruption caused by circumstances beyond our reasonable control, including transport disruption, supplier failure, strikes, public restrictions, weather events, technical outages, or government action.
14. Website Availability
We do not guarantee that the website will always be available, secure, uninterrupted, or error-free. We may update, suspend, withdraw, or change all or any part of the website without notice.
15. Privacy
Your use of our website and services is also governed by our Privacy Policy and Cookie Policy.
16. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms or our services, unless mandatory law provides otherwise.
